User Content and Data

Your Responsibility: You are solely responsible for any content, data, or files you submit, upload, or process through the Service. You represent and warrant that you have all necessary rights, licenses, and permissions to use such content and that it does not violate any laws or third-party rights.

No Storage: Most FixTools utilities process data entirely in your browser, meaning your data never leaves your device. For tools that require server-side processing, we process your data in real-time and do not store it after processing completes. We do not claim ownership of any content you submit through the Service.

Backup: You are responsible for maintaining backups of your data. FixTools is not responsible for any loss or corruption of data resulting from your use of the Service.

Intellectual Property

FixTools Content: The Service, including its original content, features, functionality, design, logos, and trademarks, is owned by FixTools and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content: You retain all rights to any content you submit, upload, or process through the Service. By using the Service, you grant FixTools a limited, non-exclusive, royalty-free license to process your content solely for the purpose of providing the Service to you.

Third-Party Content: The Service may contain content from third parties, including open-source libraries and APIs. Such content is subject to its respective licenses and terms.

Premium Features and Payments

FixTools offers both free and premium features. Premium features may include:

  • Processing larger files (above free tier limits)
  • Batch processing multiple files
  • Priority processing queues
  • Advanced features and tools

Payment Terms: If you purchase premium features, you agree to pay all fees associated with your purchase. All fees are non-refundable unless required by law or as otherwise stated. Prices are subject to change at any time, but changes will not affect purchases already made.

Payment Processing: Payments are processed by third-party payment processors (e.g., Stripe). You agree to comply with their terms and conditions. FixTools is not responsible for any issues arising from payment processing.

Service Availability

We strive to provide reliable and uninterrupted service, but we do not guarantee that the Service will be available at all times. The Service may be unavailable due to:

  • Scheduled maintenance or updates
  • Technical issues or server problems
  • Force majeure events (natural disasters, cyber attacks, etc.)
  • Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any loss or damage resulting from Service unavailability.

Indemnification

You agree to indemnify, defend, and hold harmless FixTools and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your infringement of any third-party rights
  • Any content you submit, upload, or process through the Service

Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Request by law enforcement or government agencies
  • Extended periods of inactivity
  • Discontinuation or material modification of the Service

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will notify you by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of FixTools after any changes to these Terms constitutes your acceptance of such changes. If you do not agree to the new Terms, you must stop using the Service.

We encourage you to review these Terms periodically to stay informed about our terms and conditions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FixTools regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
